You will manage and conduct a disrepair litigation caseload for business including disrepair claims, counterclaims and defending EPA 1990 prosecutions, access injunctions, maximizing capacity to retain legal cases in-house ensuring value for money without compromising case outcomes. From time to time, support nominated client officers from the Disrepair Team to draft particulars of claim, particulars of defence, defence to counterclaims, legal notices, instructions to expert surveyors, witness statements and injunction applications.
You will also provide legal advice to instructing client (Disrepair Manager) on merits or otherwise of disrepair claims and where appropriate, advice on quantum and provide training seminars/updates on recent developments (statutory and/or decided cases) in housing law to the client Disrepair Team. You will support the Disrepair Manager to ensure legal risks are identified in processes and procedures at an early stage.
Duties of Housing Lawyer (Disrepair):
- Deliver legal services to the business, meet agreed KPIs and ensure value for money.
- Conduct a wide variety of disrepair cases as allocated by the Interim Lead Disrepair Lawyer and seek to achieve optimum outcomes for the business.
- Support client officers from the Disrepair Team to conduct appropriate legal case work, maximizing capacity to retain legal cases in-house ensuring value for money without compromising case outcomes.
- Support and effectively advise client officers in the Disrepair Team to resolve disrepair claims without need for litigation (in appropriate cases), ensuring that litigation is the last resort.
- Assist and deputise for the Interim Lead Disrepair Lawyer in managing legal services effectively for the team.
- Ensure that all business legal services have effective and innovative policies, procedures and systems covering all aspects of work.
- Ensuring these are operated properly in conjunction with the Risk Management frameworks, encompassing Health and Safety, Data Protection and demonstrate effective controls and compliance with all statutory, regulatory and policy requirements relating to the management of the business.
About you:
- You may be a Solicitor, Barrister or a Fellow of ILEX
- Must hold a valid Practising Certificate.
- Experience in Disrepair cases.
- Experience in managing own caseload and working to agreed levels of billing and time recording.
- An effective communicator, both orally and in writing, having a good command of written English.
- High level of commercial awareness and ability to adapt to changing needs of the business.
- Ability to work under pressure, conducting a high volume of cases against tight deadlines, with a strong delivery focus.
- Excellent drafting skills and legal acumen.
- Flexibility is required to meet the organisations business needs and deadlines
